Kylie Jenner’s trademark battle

Trademark Application

Kylie Jenner has been on a rampage with filing trademark applications, and showing no signs of slowing down. Recently, she has applied for a variety of trademarks containing her daughter “Stormi”‘s name. It appears Business Moves Consulting Inc, the owner of “Stormi Couture®” isn’t too happy about these recent filings.

On January 14, 2020 Kylie’s trademark “STORMI WORLD” for registration in International Class 025 (an apparel class) was published to the public for opposition. In US trademark applications, if the examining attorney for the United States Patent and Trademark Office (USPTO) raises no objections to registration, or if the applicant has overcome all rejections, the trademark is published in the “Official Gazette”. The public then have 30 days from the date of publication (in Kylie’s “STORMI WORLD” case, 30 days from January 14, 2020) to oppose registration of the mark OR file a request to extend the time to oppose. On January 18, 2020, Business Moves Consulting Inc did the latter – they filed (and were granted) an extension of time to oppose; then on February 18, 2020 they filed their opposition.

Kylie Jenner must now answer Business Moves Consulting Inc’s within 40 days from the date of the order (so her answer is due March 29, 2020). We wait with baited breath.

Interestingly, Business Moves Consulting Inc have also filed (and have been granted) extensions of times to oppose Kylie’s trademark applications for “STORMI WORLD” for registration in International Class 028; “STORMI WORLD” for registration in International Class 035; “STORMIWORLD” for registration in International Class 041; and “STORMI” for registration in International Class 003. So there could be more opposition filings looming for Kylie and her trademark rampage.
